Terms and Conditions

The following are the terms and conditions of Kiddiecasts and sets out the conditions on which we do business with you the customer. All reference to goods refers to official products supplied by Kiddiecasts.

These terms apply to any goods provided by Kiddiecasts, 21 Mallard Way, Bradwell, Great Yarmouth, Norfolk  NR31 8JY.

Pricing

All prices of goods and services quoted are inclusive of VAT and exclusive of postage (if applicable).

We reserve the right to change our prices for goods and postage at anytime.

If you make an enquiry and we quote you a price for goods or postage, these prices will remain for a period of 30 days from the date of the quote.

Promotions/Special Offers

Only one promotional or special offer code can be used per order.    We reserve the right to change or withdraw promotions and special offers at any time without notice.  Discounts do not apply to gift vouchers.

Ordering and Payment

In person

We currently accept payment by cash or cheque with guarantee card.  As all goods are personalised and cannot be resold, full payment is required at the time of placing your order.   Goods cannot be issued until full payment is received.

If you decide to cancel your order after attending your appointment, we are unable to offer a refund as all items are personalised and are not suitable for resale.

In the event that we are unable to produce a cast that meets our high standard, we will contact you to arrange another appointment.   If you decide to cancel your order at this stage, we will reimburse your payment in full.   If for any other reason we are unable to fulfil your order and you therefore decide to cancel the order, we will reimburse any payments you have made in full.

Online

Products available to purchase online use Paypal’s secure online ordering system.  Items can be ordered by using the payment buttons shown beside the items.   Payment is required in full and cannot be refunded once order is placed.  If you order in error, please contact us within 24 hours so that the issue can be resolved.  It is likely that after this time, work will have started on your order and as they are personalised items, a refund will not be possible.

Collection of Goods

We will contact you once your order is complete and agree a convenient collection date .   All finished goods will be available for collection for up to 3 months from agreed collection date.  We cannot hold items after this time, if the final collection date is exceeded, the goods will be disposed of.

Returns, Refunds & Cancellations of Online Orders

Please do not return any goods until you have contacted us by telephone or email.

Kiddiecasts adheres to the distance selling regulations (UK) 2000.  If you change your mind, then you may return any off the shelf items (such as print kits) for a full refund (excluding delivery charges) within 7 working days of delivery.  A refund will be given providing we receive the goods back in their original condition (unopened, unused, in their original packaging and fit for resale).  We are not obliged to refund our delivery costs and the customer must pay the postage costs to return the item.  Goods must be returned by recorded delivery as Kiddiecasts cannot be held responsible for items returned by other methods.

Please note that custom-made and personalised items such as such as silver prints jewellery and mugs are excluded from this and may only be returned if faulty or not as specified.  If you wish to return any items purchased from Kiddiecasts  please ensure you have contacted us first.

Return of Faulty and Incorrect Products Ordered Online

Please do not return goods until you have contacted us by telephone or email.

Faulty products may be returned for a full refund within 7 days or for a replacement product up to 30 days after delivery.  If the products you return are faulty or incorrect, we will refund you the cost of the return postage, as well as the goods and your original postage and packing charge.  We will need to have received any faulty items back before a replacement can be sent. Goods must be returned with proof of purchase by registered post only. We cannot be held responsible for any item returned to us in any other way. Refunds will be paid for items which fulfill the above requirements.

Return of faulty goods – ordered in person at an appointment

This clause applies to personalised items supplied, such as silver prints jewellery and 3D casts ordered as part of our personal casting service.  If the goods that we have supplied are claimed to be defective, they must be returned to us for inspection within 12 months of your agreed collection date.  If we determine that the defect is caused by poor workmanship, then we will offer a free repair, replacement or refund.  If the defect or damage has not been caused by us, no replacement or refund will be given, but we may be able to offer a repair for which additional charges may apply.  We are not able to offer refunds on personal items if you change your mind.

Product Photographs

We take photographs of most of our work for our portfolio, some of these photographs may be used on our website, social pages and in promotional material. If you do not wish for your items to be used in this way, please let us know either at your appointment or by emailing sales(at)kiddiecasts.co.uk.

Disclaimer

We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the goods supplied by Kiddiecasts. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) provided that nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the goods supplied

General

We reserve the right to cancel the appointment without refund of payment, if we receive abusive or threatening behaviour. 

We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.

We reserve the right to supplement and amend the Terms and Conditions from time to time.

These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
